These terms govern use of the Accent platform (accentcrm.com) by dealerships and their authorized staff.

The service

Accent is a customer-relationship management platform for powersports dealerships: customer management, follow-up scheduling, two-way messaging, appointments, desking worksheets, and credit-application handling. We may improve or modify features over time.

Accounts

• Accounts are provisioned for dealership staff. You are responsible for your credentials and for activity under your account.
• Dealership administrators control their staff’s roles and permissions.

Messaging through the platform

A dealership that uses the platform’s messaging features is the sender of those messages. It sends from its own phone numbers, under its own messaging registration, to its own customers. Accent supplies the software. We do not send messages on behalf of dealerships under our brand or our numbers, and we do not operate any third-party marketing or lead-generation messaging.

• Consent to contact. The dealership is responsible for obtaining and honoring each of its customers’ consent to be contacted by call, text, or email, and for complying with applicable communications laws including the TCPA, carrier rules, and do-not-call requests.
• Registration. The dealership is responsible for its own carrier and brand messaging registration, and for using it only for the use case it registered.
• Opt-outs. STOP and HELP keywords must be honored. The platform supports them.
• Call recording. Where call recording or transcription is enabled, the dealership is responsible for satisfying any notice or consent requirements in its jurisdiction.
• Data accuracy. Customer information entered into the platform is the dealership’s responsibility.

Credit applications

Accent is a software platform. We are not a lender, loan broker, or credit repair organization, and we make no credit decisions. Credit applications a consumer chooses to submit are transmitted to lenders at the dealership’s direction as part of processing that application. Approval, terms, and rates are determined solely by the lender.

Acceptable use

• No unlawful, deceptive, or harassing messaging; no messaging without required consent; no purchased, rented, or third-party-sourced contact lists; no affiliate marketing or lead-generation messaging; no content prohibited by carrier or messaging-industry policies, including SHAFT categories.
• No attempts to break, probe, or overload the service, or to access data you are not authorized to see.

Intellectual property

The platform, including its software and design, is owned by Accent. Dealership and customer data remains the dealership’s; we use it only to provide the service.

Disclaimers

The service is provided “as is” without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We do not guarantee uninterrupted or error-free operation, message delivery, or third-party carrier, lender, or hosting performance.

Limitation of liability

To the maximum extent permitted by law, Accent will not be liable for indirect, incidental, special, consequential, or punitive damages, or lost profits or data. Our total liability for any claim is limited to the amounts paid for the service in the twelve months preceding the claim.

Termination

We may suspend or terminate access for breach of these terms. Dealerships may stop using the service at any time; data-export requests should be sent to support@accentcrm.com.

Governing law

These terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

Changes

We may update these terms. The “Last updated” date reflects the current version. Continued use after changes constitutes acceptance.
